Offenses/Disposition

Prior and Current Offenses

1. 3 or more prior convictions/adjudications:  Check this item if the youth has had 3 or more convictions/adjudications prior to the convictions/adjudications that are currently being dealt with.  Score convictions/adjudications that occurred at three different points in time no matter how many charges are adjudicated at each time. (If several offenses occurred at the same time, create a record of them, but count the offenses as just one set because this item is concerned with crime spree.)   Do not count probation/parole violations in this item.  Do not count diversion and/or continuance for dismissal. Do not count petty traffic offenses.

2. 2 or more prior failures to comply:  These include failures to appear, probation/parole violations, escape from custody, failure to comply with alternative measures, unlawfully at large; this applies only to actual convictions/adjudications. Check this item if charges were filed or probation/parole was suspended under community supervision.

   • Include formal parole/probation revocation.
   • Include move to a higher level of supervision.
   • Do not include Behavior Accountability Meeting.
   • Do not include diversion because no previous adjudication exists.
3. Prior probation:  Check if the youth has ever been on probation or unsupervised probation. Do not count supervision for status offense unless the youth has been adjudicated delinquent as a result of three or more prior status offenses—this can be three offenses on one occasion.  Do not include probation for minor traffic offenses. Do not check this item for current offenses for which the youth is on probation, but include prior probation cases that have been closed.

4. Prior custody: Check if the youth has ever been sentenced or committed to an open or secure facility by a judge or magistrate post-disposition only (custody for convictions/adjudications only).  This should not be checked if the youth has only been held pre-trial. Count placements that result from a delinquency petition but not those made for the youth’s welfare.

   • Include post-disposition detention only.
   • Include any placement ordered as a consequence for delinquent behavior.
   • Do not include placements made for a youth’s safety.
5. 3 or more current convictions/adjudications:  Check this item if the youth has received three or more convictions/adjudications for the current disposition.  Do not count pending or dropped charges.  Circle this item if you do not know the number of offenses for which the juvenile will be supervised.  If several offenses occurred on the same date at the same time, create a record of them, but count the offenses as just one set because this item is concerned with crime sprees (i.e. sets of convictions/adjudications occurring at different points in time).
