B. Foster Parent Liability and Damage Insurance

The insurance policy provides:

  1. Liability Coverage:
    1. Protection in the event a foster child in a foster family's care is injured and the foster parents are sued by the child's biological parents or guardian;
    2. Protection from claims for bodily injury or property damage to the person or property of another because of an act of the foster child (property damage caused intentionally by a foster child is excluded);
    3. Personal injury liability coverage for such things as liable, slander, false arrest, wrongful eviction, and alienation of the affection of the foster child from his/her biological parent; and
    4. Incidental malpractice liability coverage for failure to provide needed medical care, therapy, diet or other special needs of the foster child.
  2. Damage Coverage:

    Property damage to the foster parents' property caused by a foster child and occurring while the foster child is in the care and custody of the foster parents. There is a $5,000.00 limit per claim.

    This coverage has a $250.00 deductible for each approved claim. NDSS will reimburse the foster family for $200.00 of that amount. The foster family will not be reimbursed by either NDSS or the insurance company for the remaining $50.00.
