D. Process

If foster parents believe they have a potential claim, they should contact Foster Parent Services, Inc., at (814) 736-9689. The call may be made collect. The agent for Foster Parent Services, Inc., will advise whether the foster parents should use their personal insurance or file a claim through Foster Parent Services, Inc. Personal insurance will be the primary source of payment, so it is important that foster parents know what coverage they have. (While it is anticipated that foster parents would advise the case manager of the incident, their doing so is not a requirement for the insurance process per se. If foster parents do contact the case manager, the case manager shall assure that they are aware of the insurance claim process, but the case manager is not responsible for filing the claim.)

The agent will complete a claim form and decide if there appears to be a valid claim. If the insurance agent believes a claim should be filed, the agent will have the claim processed and mail a copy of the claim form to Pat Taft, Administrator, Community Resource Development and Volunteer Services in Central Office.

If the claim is approved, the company will mail a check to the foster parent, as well as a letter to NDSS saying the claim was paid. NDSS will process a payment of $200.00 to the foster parents for NDSS's share of the $250.00 deductible.

If the insurance company denies the claim, the company will send the denial and the miscellaneous claims information to the foster parent and to Pat Taft.

If the claim is denied, the foster parent may file a claim against the State of Nebraska, using a "Claim for Injury or Damage" form. This form is available from the Office of Risk Management/State Claims Board, P. O. Box 94931, Lincoln, Nebraska 68509 (telephone number 402-471-2251). The filing of this claim is not a guarantee of payment. Each claim is reviewed by the State Claims Board, and payment of damages is generally only approved where legal liability on the part of the State, its agents, or its employees, is proven.

In some cases, the insurance agent will tell the foster parent there is no reason to file a claim. If this occurs, the agent will advise the foster parent how to file a miscellaneous claim through the State Claims Board. If the State Claims Board denies the claim, the Claims Board will notify the foster parent and NDSS. If they approve the claim, they will send a check to the foster parent and send a bill to NDSS for the cost.
