Non-Time Limited

These aliens are identified as follows:

Permanent residents with 40 Social Security work quarters;

Veterans fulfilling the minimum active duty requirements within the United States military and receiving an honorable discharge;

Aliens who were on active duty in the United States Armed Forces;

Spouses or unmarried dependent children of veterans or active duty United States military;

Aliens, aliens’ children or alien children’s parents who have been battered or subjected to extreme cruelty (Call Central Office);

Children, elderly (over 65), and aliens currently disabled (as defined by the Food Stamp Act) or who become disabled in the future and were lawfully present in the United States on 8-22-96;

Hmong/Lao who fought on behalf of the United States during the Vietnam era or their spouses, widows and dependent children (Call Central Office);

Native Americans with treaty rights to cross United States borders with Canada and Mexico regardless of whether they were born in Canada or Mexico (Call Central Office).

EXAMPLES OF NON TIME-LIMITED ALIENS

  1. Hans Hoffmen, his wife and two children emigrated to the United States from Germany. Mr. and Mrs. Hoffmen and their children were admitted to the United States as permanent residents.

    The SSW requests a printout of both Mr. and Mrs. Hoffmen’s Social Security work quarters. The printout is received and Mr. Hoffmen has 16 work quarters and his wife has 26 quarters. They can share in each other’s quarters earned during their marriage. Their total combined work quarters equal 42.

    Mr. and Mrs. Hoffmen and their children would be eligible as permanent residents.

    with 40 work quarters. Their children would continue in this status, using their parent’s work quarters, until they turn eighteen years of age. Their food stamps are federally funded. N-FOCUS is coded “Lawful permanent resident with work quarters."

  2. Ivan Illick was admitted to the United States from Austria as a permanent resident. Two years after his entry to the United States, he married Eva Gabour. Ms. Gabour was admitted to the United States from Czechoslovakia as a permanent resident 4 years previously. Ivan and Eva Illick and their 4 children apply for food stamps.

    Printouts of work quarters were requested for both Ivan and Eva. The printouts were received showing 24 work quarters for Ivan and 25 work quarters for Eva. All of their children are United States citizens. Ivan has earned 16 work quarters since their marriage and Eva has earned 9. Ivan is NOT federally funded for food stamps because his total work quarters equal 33 (24 + 9). His food stamps are state funded. N-FOCUS is coded “lawful permanent resident.".

    Eva is federally funded for food stamps because her total work quarters (25 + 16) equal 41. N-FOCUS is coded “Lawful permanent resident with worker quarters.” The children are coded as United States citizens.

  3. Randy Jacuzzi, his wife and one child were admitted to the United States as permanent residents from Mexico. They apply for food stamps. Printout of Social Security work quarters was received. Both Mr. and Mrs. Jacuzzi have 20 work quarters each. Because the Jacuzzis are married, they may share each other’s work quarters earned during the marriage. Their child can also share her parent’s work quarters until age eighteen. Their food stamps are federally funded. N-FOCUS is coded “Lawful permanent resident with work quarters.”
  4. Henry Kissing emigrated to the United States in 1938. Mr. Kissing applies for food stamps. During the interview, Mr. Kissing indicates that he received an honorable discharge from the United States Army. He provided his DD 214. His food stamps are federally funded. N-FOCUS is coded “Veteran-Honorable Discharge.”
  5. General Joseph M. Shellycash and his family apply for food stamps. General Shellycash is in the Unites States Army. He emigrated to the United States from Germany. His food stamps are federally funded. N-FOCUS is coded “Active Military Duty.” If his wife and children are not United States citizens, they also would be federally funded for food stamps. N-FOCUS is coded “Spouse of Qualified Veteran or Active Enlistee” and “Child of Qualified Veteran or Active Enlistee.”
  6. Grace is a non citizen. She has been battered and subjected to extreme cruelty by an abusive United States citizen or permanent resident spouse or parent. She applies for food stamps. She provides documentation that she applied for and has been granted special immigration status as a battered spouse under the Violence Against Women Act. After approval of her petition, her food stamps are federally funded. N-FOCUS is coded as “Worker Determined Eligible-FS.” If she has not petitioned for a status change, her worker may inform her of the necessary steps. Call Central Office.
  7. Du Tho was born in Laos and is a member of a Highland Hmong tribe . He fought for the United States during the Vietnam war era. He applies for food stamps. His food stamps are federally funded. Call Central Office. N-FOCUS is coded “Hmong or Highland Lao Veteran.”
