Youth who were committed to the Office of Juvenile Services (including youth who were committed to OJS before January 1, 1997 and continue in OJS custody) are covered by the following procedures.
A. Required Documents - New Cases
1. Application: Court order placing youth into custody of HHS, OJS, or court order placing youth into custody of Office of Juvenile Services when the parole officer has determined that the youth legally is in HHS, OJS custody;
2. Determination of Youth's Income and Resources: Form IM-18FC;
3. Determination of Family's Income and Resources: Form DCS-F-601, "Social History of Investigation and Home Evaluation," pp. 1, 2, 5, and 6;
4. Health Insurance Information: Form ASD-60;
5. Determination of IV-E Eligibility:
a. Petition which led to the removal of the youth from home;
b. Court order which led to removal of the youth from home; and
c. First court order which addresses reasonable efforts to prevent removal from home or to alleviate conditions which necessitate continued out of home placement;
Note: It is possible that the same order or orders will meet the requirements for application and IV-E eligibility)
6. Desk Aid for CWIS case conversion; and
7. The Foster Care Payment Determination Checklist, when applicable.
The forms have a place for signature of the person completing them and a date. It is important for the social service worker to have current information. If the date of application is more than three months after the "Date completed," the parole regional support staff person will be responsible for assuring that the information was verified within the three months and will fill in the second date and will sign on the signature line.
B. Required Documents: Status Change (to be used when a youth receiving assistance moves from one placement to another or is discharged from custody, or when there is a change in payment amount): Use "Out-of-Home Payment" Form.
Completion of the forms is the responsibility of the parole officer, although the officer might not actually fill out the form himself or herself, e.g., a parent might complete the ASD-60, with the parole officer maintaining the responsibility of getting the form to the parent and seeing that it is returned. The parole officer forwards completed forms and documents to the appropriate OJS support person, who forwards them to the appropriate social service worker.
Upon receipt of the needed documents, the social service worker will determine eligibility for IV-E and Medicaid and open the appropriate case.
The primary parole officer retains responsibility for the case regardless of where the ward is placed. The social service worker in the district where the parole officer works is responsible for the maintenance/Medicaid case.
Youth who are in one of the Youth Residential Treatment Centers (RTC) are not eligible for Medicaid or IV-E because of their living situation. The application can be made prior to release, which would allow time for the social service worker to process the information and be able to make a determination of eligibility upon release.
