Evidence of Lawful Admission for Permanent Residence in the United States

 

Primary Sources

a. Alien Lawfully Admitted for Permanent Residence

INS Form I-551 (Alien Registration Receipt Card, commonly known as a "green card"); or

Unexpired Temporary I-551 stamp in foreign passport or on INS Form I-94.

b. Asylee

INS Form I-94 annotated with stamp showing grant of asylum under section 208 of the INA;

INS Form I-688B (Employment Authorization Card) annotated "274a.12(a)(5)";

Grant letter from the Asylum Office of INS; or

Order of an immigration judge granting asylum.

c. Refugee

INS Form I-94 annotated with stamp showing admission under Sec. 207 of the INA;

INS Form I-688B (Employment Authorization Card) annotated "274.12(a)(3)";

INS Form I-766 (Employment Authorization Document) annotated "A3"; or

INS Form I-571 (Refugee Travel Document).

d. Documentation in the form of correspondence from the Immigration and Naturalization Service stating the client -

(1) Has been granted an indefinite voluntary departure;

(2) Has been granted an indefinite stay of deportation;

(3) Is not under direct order of deportation; or

(4) Has been admitted as an Amerasian (authorization for this group of individuals expires March 20, 1990).

e. Evidence of continuous residence in the United States before June 30, 1948. This evidence may include -

(1) School records;

(2) A marriage license;

(3) A voter registration card;

(4) An insurance policy;

(5) Military service records; or

(6) SSA records that a Social Security number was issued before 1948.

f. Form I-689 receipt for aliens seeking immigration status under the Immigration Reform and Control Act of 1986.

g. Documentation that the individual is an Amerasian admitted through the Orderly Departure Program. The documentation will be either an adapted Form I-94 or Form I-155 (see 469-000-314 for more information on the documents).

Note: A Social Security card is not proof of eligible alien status.

Verification Follow-Up: After documentation is received identifying that the alien is eligible under one of the established categories, the worker shall verify the alien's documentation through the Systematic Alien Verification for Entitlements (SAVE) procedures. See 469-000-313 for SAVE procedures.
