468 NAC 2-006.07A

When unmarried parents are living together as a family, the alleged father is considered financially responsible if he has acknowledged paternity or a court has determined that he is the father of the child after the birth.

 

Note: Paternity cannot be established for an unborn.

Paternity cannot be established for an unborn without a signed and notarized paternity acknowledgment. An unborn is not referred to CSE until the child is born.
Absent a marriage, some courts will order the father to pay childbirth expenses even though his income was used in determining eligibility at that time.
