Procedures have been set up to withhold unemployment compensation benefits payable to an absent parent when s/he has a debt to the State. If income, earned or unearned, is being garnished, the garnishment is not deducted from income in the budgeting process. If unearned income is being reduced because of a previous overpayment, the amount of the benefit before the deduction of the overpayment is considered as income.
Exception: The amount after deduction of the overpayment is used if the client received both ADC/MA and the other benefit at any time during which the overpayment occurred and the overpaid amount was included in the ADC/MA budget.
