Application for medical assistance constitutes an automatic assignment to the Nebraska Department of Health and Human Services of the client's rights to third party medical payments. For child support requirements, see 468 NAC 2-019 ff. This assignment includes the rights of the client as well as the rights of any other member of the ADC/MA unit.
This assignment gives the Department the right to pursue and receive payments from any third party liable to pay for the cost of medical care and services of the client or any other unit member and which otherwise would be covered by NMAP.
