5-015.18B Protective Payee
473 NAC 5-015.18B
To assess the need for and to initiate protective payee proceedings, the worker shall -
1. Determine that the client needs a protective payee when the client has a physical/mental impairment which causes an inability to manage public assistance benefits;
2. Contact the client's income maintenance worker to request that a protective payee be appointed; and
3. Document the information necessary to establish a protective payee. This includes -
a. Medical evidence, when appropriate (e.g., a physician's statement or a medical report) to substantiate the need for protective payee;
b. Evidence of the client's need for a protective payee including -
(1) Continued inability to plan necessary expenditures over the usual assistance period;
(2) Persistent failures to meet obligations for the essentials, such as food or rent; or
(3) Repeated evictions or incurrence of debts with attachments or levies against the current income; and
c. The reason protective payments were selected instead of guardianship or conservatorship.
