5-015.18C Representative Payee
473 NAC 5-015.18C
In assessing the need for and initiating representative payee proceedings the worker shall -
1. Determine that the client needs a representative payee when -
a. The client is unable to manage Social Security and/or SSI benefits;
b. Efforts to teach money management skills to the client have been unsuccessful; and
c. There is not enough evidence available to appoint a guardian or conservator;
2. Contact the Social Security Administration to request that a representative payee be appointed; and
3. Document the information necessary for establishment of a representative payee. This includes one or more of the following:
a. A court finding of incompetency;
b. A commitment to an institution;
c. Medical and/or legal evidence of the client's incapacity to manage benefit funds or protect his/her own interest (e.g., drug addiction or alcoholism);
d. Presentation of guardianship or conservatorship papers; and
e. Other documentation to demonstrate that the client is incapable of managing his/her benefits in order to meet his/her personal needs.
