If Department records are subpoenaed or a worker is testifying in court, Section 28-719, R.R.S., 1943, protects the reporter's name from disclosure.

 

When the worker has completed an investigation only or service has been refused and no case is opened, the case record must include items 1, 2, 3, 4, 6 10, 11, 13, 14, and 15 (see 473 NAC 5-015.32).

 

APS staff shall keep a separate listing of contacts with the county attorney, Attorney General's Office, or Legal Services Division in Central Office. Then, if a case file is subpoenaed, this listing can be pulled from the case record and protected under attorney - client privilege.
