473 NAC 5-015.13

When service planning is required the worker shall develop a service plan within 15 days of case status determination. To initiate service planning, the worker shall -

1. Determine what action is necessary to enhance the adult's self-sufficiency and at the same time protect him/her. This may be determined by evaluating the -

a. Specific problems relating to care/protection of the adult;

b. Positive and negative factors in the environment;

c. Strengths and weaknesses of the adult;

d. Adult's and/or others' capacity and motivation to deal with these problems;

e. Possible approaches to solving these problems;

f. Specific goals for improved care/protection of the adult; and

g. Decisions about which services will be provided, how and by whom, including referral to other community services and mobilization of the adult's resources;

2. Determine whether "Arranging for Legal Services" (see 473 NAC 5-015.19) is needed;

3. Discuss the findings of the investigation and needs assessment with the adult and his/her representative, if any;

4. Explain to the adult and his/her representative, if any, the services which are available through the local unit and other community services resources;

5. Obtain acceptance of services from the adult or his/her legal representative, if any. The adult's or his/her legal representative's signature on Form DSS-3A or DA-100, "Social Service Application," documents acceptance of services.

a. If the adult or his/her representative accepts services, the worker shall -

(1) Develop a service plan with the client, utilizing shared decision making, as appropriate; and

(2) Develop a contract based on the service plan which states the goals, priorities, and the time-frame that the client will be working toward. Case management responsibility involves a continuous evaluation of the priorities and goals of the contract and an assessment of the client's progress in accomplishing these goals. When possible, the client or the client's legal representative and the worker shall sign the contract.

b. If the adult or his/her legal representative does not accept service, the worker shall terminate the protective service involvement. (Protective services may not be provided beyond the 60-day period without acceptance of services by the adult or his/her legal representative unless court action has been initiated within the 60-day period. Form DSS-3A or DA-100 does not need to be signed if court action has been initiated within the 60-day period.) If, at any time during the 60-day period the adult or his/her legal representative willingly accepts services, a Form DSS-3A or DA-100 must be completed and signed to continue services beyond 60 days;

6. Arrange protective services and other appropriate services (see 473 NAC 2-004.01C2) only after Form DSS-3A or DA-100 has been signed or court action has been initiated. The worker shall -

a. Determine categories of eligibility for the adult (see 473 NAC 2-002.01). All other eligibility categories must be explored and found inappropriate before a client is considered eligible without regard to income (WI) status;

b. Complete Form DSS-4, "Case Information Summary," Form DSS-4 must be completed on all case status determinations of "Court Substantiated," "Petition to be Filed," and "Services Accepted." The worker shall -

(1) Indicate code 15, Adult Protective Services case management, for up to a maximum of six months. (See 473 NAC 5-015.03A APS Time Limits); and/or

(2) Indicate appropriate Title XX services (see 473 NAC 5-015.17). Maximum authorization time period for WI clients is 31 days. Form DSS-60 must be filed with the Adult Central Registry before services are provided; and

c. Complete Form DSS-4A, "Social Services provider authorization," authorizing appropriate Title XX services; and

7. Arrange or coordinate substitute financial management (see 473 NAC 5-015.18).
