1-008.03F1 Individuals with Fewer Than Three Felony Drug-Related Convictions

Individuals who have fewer than three drug-related felony convictions for the possession or use of a controlled substance may be eligible for Food Stamp benefits. When the convicted drug felon is participating in or has completed a nationally accredited or state-licensed substance abuse treatment program since the date of the last conviction, s/he is not disqualified from the Food Stamp Program. The determination of participation or completion of the substance abuse program must be made by the provider administering the program.

The listing of facilities is state only and does not include those facilities approved, licensed, or accredited by the federal government.

Note: Eligible drug treatment programs include the substance abuse treatment programs provided by the Nebraska Department of Corrections.

 

 

The individual would not be disqualified from the Food Stamp Program:

1. During the participation in and upon completion of the approved substance abuse treatment program following the first drug-related felony conviction; or

2. During the participation in and upon completion of the approved substance abuse treatment program after the second drug-related felony conviction.

For individuals with fewer than three drug-related felony violations and convictions for the possession or use of a controlled substance, who are participating in or have completed an approved substance abuse treatment program since the date of the last conviction, refer to 475 NAC 3-001.08B, "Eligible Drug Felon".
