1-007.05B Decisions Resulting in Benefit Decrease

Fair hearing decisions which result in a decrease in benefits must be reflected in the household’s next scheduled issuance following the local office’s receipt of the hearing decision. If the client has received benefits to which s/he was not entitled pending the fair hearing decision, a claim must be filed. In the case of a disqualification such as a work requirement, the worker must disqualify the household or the household member beginning with the month after the receipt of the fair hearing decision.
