475 NAC 1-007
A fair hearing must be provided to any household wishing to appeal any action or inaction of the local office which affects the household’s participation. Fair hearings may be conducted at the local office either by telephone with a hearing officer or a hearing officer coming to the local office. The household member requesting the fair hearing will be notified by the HHS Legal Division of which type of hearing will be held. The household must be given the option of requesting a face-to-face hearing if a telephone hearing was scheduled.
Exception: Households are not entitled to a fair hearing to contest solely:
1. Reductions, suspensions, or cancellations of benefits which have been ordered for the entire program;

2. Mass changes in state grants which affect the food stamp benefit level; and

3. Allotment reduction because of failure to pay an outstanding claim.
