6-002.06F2a(2) Time Limits for Liquidation
The worker must exclude real property which the former ward is making a good faith effort to sell.
First the worker shall determine if the individual has the legal authority to liquidate the property. If not, the former ward is allowed 60 days to initiate legal action to obtain authority to liquidate (see 479 NAC 6-002.06B1). If the former ward owns the property with other persons who are not on assistance, see 479 NAC 6-002.06F2a(2)(b).Once the former ward has the legal authority to liquidate the property, the worker must obtain the former ward's or responsible relative's signature on Form IM-1. The former ward or responsible relative is allowed six calendar months to liquidate the real property. If the former ward or responsible relative refuses to sign Form IM-1, the former ward is immediately ineligible because of excess resources.
One liquidation period is allowed for each piece of real property that is determined to cause excess resources, even if the case is closed and subsequently reopened.
