3-002.03A2a Excluded Vendor Payments

475 NAC 3-002.03A2a

Excluded vendor payments include:

1. Support payments which are not required by a court order or other legally binding agreement, including payments exceeding the amount specified in a court order or agreement, which are paid directly to a third party rather than the household;

2. Rent paid directly to the landlord by a household member’s employer in addition to the member’s regular wages;

3. Rent or mortgage payments made to landlords or mortgagees by Housing and Urban Development (HUD) or a state or local housing authority; and

4. A PA or GA payment which is paid directly to a third party for:

a. Medical assistance;

b. Child care assistance;

c. Burial expenses;

d. Expenses incurred by migrant and seasonal farm workers while in the job stream; or

e. Expenses over and above the normal assistance payment.

GA payments for shelter are considered unearned income to the household if the household received no other additional assistance payment such as ADC.
GA payments for shelter are excluded if the household received an assistance payment AND a GA payment for shelter.
Regardless of whether the GA payment for shelter is used in the budget as unearned income, the amount the household is billed is used as a shelter deduction.
